4docs Terms

4docs.org.uk (the ‘Site’) is owned and operated by the Channel4 BRITDOC Foundation (‘we’, ‘us’, and ‘the Foundation’).

Please read the terms and conditions set out below carefully as they set out your rights and obligations and the terms on which the Foundation makes the Site available to you. They also provide information on how you can submit material, and how this will be used.

By using or visiting the Site, you agree to be bound by these terms and conditions (‘the ‘Terms’) and our Privacy Policy (which is incorporated into the Terms – see below). If you do not agree to the Terms or the Privacy Policy please do not use or visit the Site.

IMPORTANT NOTICE ABOUT USER CONTENT

Any Films, reviews, comments, data, competition entries or other content submitted by you to us via the Site or otherwise for inclusion on the Site project are referred to as ‘User Content’ in these Terms.

By providing User Content to the Site you confirm this (a) is your own work and not copied from anyone else or infringing of any third party’s rights, (b) is not defamatory, obscene, harassing, offensive, threatening, in breach of anyone’s privacy or in contempt of court, and (c) that use of your User Content by us in accordance with the rights granted by you will not infringe any third party’s copyright or other intellectual property rights, moral rights or other rights and is not subject to further conditions or payments. You must have the consent of any contributors featured in your User Content and all other rights owners in your User Content, and may be asked to provide evidence to us that you do.

You will continue to own any original content you provide (unless as otherwise agreed with you or set out on the Site) but by providing your User Content you agree that The Foundation (and those authorised by the Foundation) may use it and make it available on the Site, other 4docs branded internet sites (such as the 4docs channel on You Tube, or Facebook account) and any other sites owned and operated by or on behalf of The Foundation or associated companies and in connection with the 4docs project. Further details are set out below.

User Content will be published entirely at the Foundation’s discretion, nothing shall oblige the Foundation to use, or continue to use your User Content, and the Foundation may remove your User Content at any time for any reason.

Rules for submission of Short Documentaries (‘Films’) to the Site

While the Terms apply to submission of Films (as Films are User Content) – and you should read these in full carefully as they set out your rights and responsibilities – set out below are some of the main points to take note of before submitting your Film to us to be considered for inclusion on the Site (and on our 4docs branded channels on third party sites).

Please make sure:

  1. you have the consent of all contributors featuring in or contributing to your Film such as composers, voice artists, actors, writers, directors, designers, developers etc and have obtained all appropriate clearances in order to grant the rights granted to the Foundation under these Terms;
  2. you haven’t already given another website or other person, in any country, exclusive rights to your Film;
  3. you don’t submit any Film which isn’t your own work, or which includes anyone else’s material, like images or music unless you have their permission to use it in your Film;
  4. you haven’t used commercial music within your Film. This means not using music which is available to purchase on the high street or through online stores;
  5. you haven’t said nasty or untrue things in your Film about people or companies, or mentioned any court cases or arrests;
  6. you haven’t revealed any private information in your Film including contact details about yourself (unless you want to) or anyone else;
  7. your Film does not include anything that is defamatory, obscene, indecent, offensive, harassing, threatening, in breach of anyone’s privacy or in contempt of court or that otherwise breaches applicable laws and/or regulations;
  8. your Film must have a limit of 250MB and a cap on Film length of 20 minutes; and
  9. that you have read and agreed the Terms in full and can agree to these.

If you submit a Film in breach of the Terms, and this comes to our attention, we reserve the right to remove it from the Site.

1. YOUR OBLIGATIONS AND THE TERMS

In order to submit material to the Site you will be asked to accept the Terms and, on doing so, you will be deemed to have consented to be bound by the Terms. Any use of the Site (including, but not limited to, viewing content) constitutes your acceptance of the Terms, which takes effect the moment you first use the Site. If the Terms are not accepted in full, you do not have permission to access the Site and should stop using it immediately.

The Foundation reserves the right to change the Terms at any time by posting changes on the Site and it is your responsibility to refer to and comply with the most up to date Terms on accessing the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the Terms as modified.

2. AGE AND OTHER REQUIREMENTS

You must be 16 years or older to submit content to the Site and we reserve the right to require evidence of this before accepting any User Content submitted by you.

The Site may contain content of an adult nature and parts of the Site may not be suitable for access by children or young people under 18. Some Films or other content on the Site may be unsuitable for younger viewers and while we may provide a guidance rating or a warning where we deem this necessary we do not undertake to do so and shall have no liability for any content than may be found to be offensive or otherwise objectionable. Where you allow children or young people to view films or other content on the Site, you are responsible for making sure that this is suitable for them. You understand that this content may contain nudity or other material of a sexual nature, or may include content you may consider offensive or otherwise objectionable.

3. COMPETITIONS

You may have the chance to apply to participate in competitions on the Site (each a ‘Competition’). The Site will set out details of how to submit an entry, the process and any additional rules or requirements. Any User Content and Your Data (as defined below) supplied as part of an entry MUST comply with the Terms and other requirements as notified. Rules specific to each Competition are displayed in a notice on the page for such Competition (‘Competition Notice’) and are incorporated into the Terms. In the event of discrepancy between these terms and conditions and the Competition Notice, the Competition Notice shall prevail.

The Foundation reserves the right to disqualify incomplete entries or those that do not follow the requirements or these Terms. The Foundation does not accept responsibility for lost or delayed entries or for any errors in or unauthorised access to entries which happen because of server functions, viruses, bugs or other things that The Foundation does not control.

The Foundation reserves the right to cancel or amend the Competition or this section (Competitions) of the Terms without notice during a Competition in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside The Foundation’s reasonable control. Any changes will be posted either within these terms and conditions or the Competition Notice on the Site. Between Competitions the Foundation reserves the right to amend this section of the Terms in the same way as the rest of the Terms in accordance with Section 1 above, so please ensure you check the Terms each time you enter a Competition.

The Foundation’s decision as to whether a competition entry (‘entry’) is successful (or in the event of any argument regarding the rules, conduct or results of the entry process) is final and no correspondence will be entered into.
Employees of The Foundation or any company involved in the Competition or, any employees of a production company or any person whose Entry has been produced with funding from The Foundation or any employees of any advertising agency or web company connected with the 4docs project (and/or any subsidiary or associated companies, agents or members of their families or households of the foregoing), are not eligible to enter the Competition.

Additional eligibility requirements may apply to a specific Competition, e.g. a valid passport, visas and/or driver’s licence will be required if the Competition prize includes travel outside the United Kingdom and/or car hire. These will be set out in the Competition Notice.

By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. The Foundation reserves the right to verify the eligibility of all entrants.

The address you provide with your Entry will be used to send any prizes so please make sure this is correct. You are not entitled to enter the Competition if you are resident in a country or jurisdiction (outside the United Kingdom or Republic of Ireland) where the Competition may breach any law or regulation. Where this applies, The Foundation’s invitation to enter the Competition in such country and/or jurisdiction is withdrawn.

The Foundation assumes that by using the Site and entering the Competition (and you warrant that) you are aged 16 or over and if you are under 18, that your parents have consented to your Entry into the Competition and these Terms.

The Foundation reserves the right to request written proof of age of any winner.

The Foundation reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Terms.

In the event that any entrant is disqualified from the Competition, The Foundation in its sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Terms.

You may enter the Competition as many times as you like however where a winner has been selected and The Foundation discovers or has reasonable grounds to believe the winner has used any software or automated process either to answer questions or to make bulk entries, The Foundation may select an alternative winner. Any further winner will be selected on the same criteria as the original winner and will be subject to these Terms.
Competition entries must be made in the manner and by the closing date and time specified on the Competition Notice. Failure to do so will disqualify the entry.

There is no purchase requirement to enter a Competition and there is no charge to register for use of the Site.
Proof of posting or emailing cannot be accepted as proof of delivery. The Foundation cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to Entries, or Entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside The Foundation’s control.

Entrants should note that unless stated otherwise, The Foundation does not accept responsibility for the return of any Entries (or User Content contained in an Entry), including those consisting of artistic or other material.

Prize winners will be chosen at random unless specified otherwise in the Competition Notice, from all qualifying Entries within 28 days of the closing date specified in the Competition Notice. Tie-breakers will be judged by The Foundation and, if required by law, by an independent adjudicator. In all matters, the decision of the judge(s) and The Foundation shall be final and no correspondence or discussion shall be entered into.

Prize winners will be notified in the manner and within the time specified on the Competition Notice (and may be contacted by The Foundation or The Foundation’s nominated supplier(s)). Return of any prize notification as undeliverable or failure to reply as specified in the notification (and within the time stated) may result in disqualification and selection of an alternate winner. If more than one prize is awarded only one prize per entrant will be awarded. Competition winner(s)’ names may be published on the website.

Claims for prizes must be made in the manner and within the time specified on the Competition Notice. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.
Prizes are non-transferable and there is no cash alternative. The Foundation reserves the right to substitute prizes of equal or greater value at any time.

Prizes are awarded at The Foundation’s discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant. Where Entries are being judged on creative or artistic merit or other subjective criteria, The Foundation and/or the Competition judges (acting reasonably) reserve the right not to select a winner, and/or to remove or amend selection criteria and/or the structure and operation of the Competition if Entries are not of the requisite standard.

All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses upgrades etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner.

The Foundation shall be entitled to use any User Content supplied as part of an Entry in accordance with these Terms (see in particular Section 4 below).

The Foundation cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize. The Foundation is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude The Foundation’s liability for death or personal injury as a result of its negligence.

Winners may be requested to take part in promotional activity and The Foundation reserves the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity.

Data relating to entrants will be retained by The Foundation for a reasonable period after the Competition closes to assist The Foundation to operate competitions in a consistent manner and to deal with any queries on the Competition. See the Section 7 (Your Data) and our Privacy Policy for further details.

4. HOW WILL THE FOUNDATION USE YOUR MATERIAL?

You agree and guarantee that any User Content you provide or submit is original to you and does not infringe the copyright or any other rights of any other person. You must obtain any clearances, consents and/or waivers necessary for you to provide the User Content to us.

The Foundation does not, unless we agree this with you, claim any rights of ownership in your User Content. As such, you retain all ownership rights and, although we will be able to use the User Content as set out in the Terms, you will also have the right to use your User Content in any way you choose. Where User Content is to be used in a different way (e.g. we are asking to own this) this will be made clear on the Site and you will then be able to choose whether to provide particular User Content on that basis.

When you submit your Film or other User Content to the Site, you grant The Foundation (and parties authorised by The Foundation):

  1. in respect of a Film, where you have provided us with a link to your Film which is hosted on a third party site (a ‘hosting site’), a non-exclusive worldwide royalty free license to link to and/or embed your Film on the Site, and / or on 3rd party internet sites or web channels serving 4docs branded content (including without limitation the 4docs You Tube channel) and / or on other internet sites owned and operated by or on behalf of The Foundation or its associated companies in connection with the 4docs project and to make available to and communicate your Film to the public for such purposes via such link until such time as you remove or delete your Film from the hosting site;
  2. in respect of a Film you have submitted to us as a video file or other format,a non-exclusive worldwide royalty free licence to use, display, distribute, perform, publish, store, transmit, copy, reproduce, make derivative works or podcasts from, and make available to and communicate to the public on the Site and/or on any third party internet sites or web channels serving 4docs branded content (including without limitation the 4docs You Tube channel) and/or on other internet sites owned and operated by or on behalf of The Foundation or its associated companies, and otherwise in connection with the 4docs project (and to edit, alter, modify and adapt as necessary for such purposes) and such licence shall continue until such time as you notify us by giving us at least 30 days prior written notice that you wish us to remove your Film from the 4docs project (you can notify us here.
  3. in respect of all other User Content (such as comments), a non-exclusive irrevocable worldwide, royalty free licence (for the full period of any rights in the User Content) to use, display, publish, transmit, copy, make derivative works or podcasts from, edit, alter, store, re-format, sell and sub-licence such User Content in all media now known or invented in the future without further liability or acknowledgement to you; and
  4. you hereby give The Foundation (and parties authorised by Channel4) all necessary consents and waivers required to use your User Content in accordance with these Terms.

You acknowledge and agree that the Site and other sites on which we exhibit 4docs content may contain advertising and sponsorship and that you are happy for your User Content to appear in sites containing advertising and sponsorship.

Whether or not we own User Content, you grant The Foundation (and third parties authorised by The Foundation) the right to issue publicity (throughout the world in all media now known or invented in future) concerning the User Content and any material, service or programme in which it may be included (including without limitation the 4docs project), and for such purpose to use and reproduce your name and photograph (where these have been provided to The Foundation) and your User Content.

The Foundation does not guarantee that it will use or otherwise make available User Content. Any User Content may be rejected by The Foundation and may be edited, moderated or deleted or removed at its absolute discretion. The Foundation reserves the right not to accept User Content that is not in English and which cannot be moderated. All decisions are final and The Foundation will not enter into any discussions or correspondence about why User Content has been rejected.

The Foundation may, in appropriate circumstances, and at its sole discretion, remove or disable access to User Content that appears to be legally or otherwise problematic e.g. it infringes the copyright or other intellectual property or privacy rights of others, is defamatory etc. or for any other reason. In relation to all reviews and comments posted on the Site, authors consent to The Foundation editing such reviews to ensure compliance with the Terms.

The Foundation does not keep any comments that are not accepted for publication but may retain other User Content even if this is not published. You agree, however, that The Foundation has no obligation to keep originals or copies of any User Content or to return this to you or remove this from the Site .

5. YOU PROMISE…

You agree and confirm that:

  1. if submitting User Content you are 16 years of age or over;
  2. all information provided by you is accurate, true and up to date in all respects and at all times, all facts expressed by you in User Content are true to the best of your knowledge and belief and, if your User Content contains opinions, these are your own and genuinely and truly held by you, or, if not, that you accurately attribute them to the author;
  3. all User Content is original to you and you are fully entitled (and have all necessary consents, including music & voice clearances) to give the User Content to The Foundation (you must also have the consent of anyone featured in the User Content to provide this to us) and you are happy for this to be used as set out in the Terms.
  4. nothing in the User Content (including without limitation any content available via a link you have provided to us) will infringe the copyright or any other right of any person, breach any contract or duty of confidence, be defamatory, obscene, offensive, indecent, harassing, threatening, be in breach of any law or regulation, breach anyone’s privacy or may constitute a contempt of court or be calculated to bring any broadcaster or other person into disrepute;
  5. all User Content will comply with any additional terms or requirements on the Site and you will at all times comply with the Terms; and
  6. F. You shall not alter or modify, or attempt to alter or modify any part of the Site.

You agree to indemnify and keep indemnified The Foundation from and against all claims, damages, expenses, costs and liabilities (including legal fees) relating to or arising from your use of the Site, or your User Content or any breach or suspected breach of the Terms by you or your violation of any law or the rights of any third party.

6. OTHER SITE TERMS

Some parts of the Site may have specific terms of use (e.g. competitions, software downloads). By using these parts of the Site you are agreeing to these specific terms. If there is any conflict between the Terms and specific terms appearing on the Site, the specific terms shall prevail. You acknowledge and agree that 4docs content may be available on third party sites such as You Tube and when using such sites you shall be fully responsible for complying with the terms and conditions of such third party sites.

7. YOUR PERSONAL DATA

Personal information you are asked to supply or you supply voluntarily as part of the registration, submission or competition process and any other information relating to your User Content (e.g. information provided to The Foundation in relation to legal and best practice issues) (‘Your Data’), will be used by The Foundation, service providers and other organisations (such as companies involved in support of the Site) and by their subcontractors, employees, agents and advisors (including legal advisors) as follows: (i) to administer your submission or User Content or competition entry; (ii) in making decisions about whether User Content you seek to submit to the Site should be accepted, rejected or used; and/or (iii) as set out on the Site or the Terms or our Privacy Policy. In addition, The Foundation may at its discretion disclose this information to the police, regulatory bodies or any legal advisers in connection with any alleged criminal offence or suspected breach of the Terms by you or otherwise where required by law.

You may be requested to take part in promotional activity and The Foundation reserves the right to use your name, photographs and audio and/or visual recordings in any publicity (including as set out in Section 4) for such purposes.
Your Data supplied as part of your interaction with the Site will, unless we tell you otherwise, be able to be seen by other users of the Site so make sure you only provide information you are happy to be seen in this way. Except as set out above (or where we agree otherwise with you e.g. in relation to contacting you for marketing), Your Data will be kept private and confidential, will not be passed on to third parties without your express consent and will be used in accordance with our Privacy Policy. By using the Site you are agreeing to Your Data being used as set out above.
Where you submit User Content you agree that we may contact you to discuss your User Content or to advise you of changes to the 4docs project.

8. USE OF THE SITE
In accessing the Site, you agree to do so only for your own personal, non-commercial use and in accordance with the Terms. Unless otherwise stated, you may not copy, reproduce, download, post, store (including in any other website), distribute, transmit, broadcast, commercially exploit or modify in any way the Site’s material or content (including other User Content) or permit or assist any third party to do the same.

You agree to only use the Site for lawful purposes, in a manner which does not improperly infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by any third party. Such restriction or inhibition includes, but is not limited to, conduct which is libelous, in breach of anyone’s privacy or which may harass, cause real distress or inconvenience to any person and the transmission of obscene or offensive content or interruption of the normal flow of dialogue within the Site.

Content (including User Content) may be made available with advertising and sponsorship. Your obligations in relation to this are the same as any other content available on the Site.

Any copying, reproduction, lending or hiring, public performance, broadcasting or any other form of distribution of the User Content (including peer to peer transfers) or any other content available on the Site other than in accordance with these Terms is prohibited and will constitute a copyright infringement.

9. OTHER CONTENT, COMPLAINTS AND CONTACTING THE FOUNDATION

Although we ask all users to submit User Content that complies with the Terms, you acknowledge that User Content supplied by other users may include material you consider offensive or objectionable. The Foundation assumes no responsibility or liability for User Content and, as the User Content is created by users, it does not necessarily represent the views of The Foundation.

If you become aware of any misuse of the Site or wish to complain about any User Content or material on the Site or believe any of your rights have been violated e.g. your copyright has been infringed or you have been defamed etc., you can contact us at  HYPERLINK “mailto:contact@britdoc.org.uk” contact@britdoc.org.uk (see Section 14). We will need to know:

  • the nature of your complaint and location within the Site of the particular content or user;
  • for copyright disputes, identification of the copyrighted work you claim has been infringed and a statement that you have a good-faith belief the disputed use is not authorised by the copyright owner, its agent, or the law and that you are the owner of the copyright interest involved or are authorised to act on behalf of the owner; and
  • your name, address, telephone number and email address and such other information as we may reasonably request.

10. THIRD PARTY SITES/LINKS

The Foundation is not responsible for the availability or content of any third party websites or material you access through the Site (including without limitation any User Content linked to or embedded in the Site). If you decide to visit any linked site, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or other destructive elements. The Foundation does not endorse and is not responsible or liable for any content, advertising, products, services or information on or available from third party websites or material (including payment for and delivery of such products or services) or for any damage, loss or offence caused by or, in connection with, the same. Any terms, conditions, warranties or representations associated with such dealings, are solely between you and the relevant provider of the service.

You may link to your own User Content on the Site or send links to other people’s User Content on the Site via email.

Other than this, links to the Site must be direct to the 4docs.org.uk homepage (and not any part of the page) and must not be viewed within the pages of any other site. The Foundation disclaims all liability for any legal or other consequences (including for infringement of third party rights) of links made to the Site.

Links do not imply that The Foundation endorses, is affiliated or associated with any linked site, or is legally authorised to use any trademark, trade name, logo or copyright symbol displayed in or accessible through the links, or that any linked site is authorised to use any trademark, trade name, logo or copyright symbol of The Foundation or any of its subsidiaries. The Foundation reserves the right to request that any links are removed at any time and you agree to comply with such request.

11. DISCLAIMER/LIMITATION OF LIABILITY

The Site, User Content and information, images, logos and content relating to the Site, or The Foundation’s and/or any of The Foundation’s associated companies’, products and services (or to third party products and services), are provided ‘AS IS’ and on an ‘AS AVAILABLE’ basis without any representation, endorsement or warranty of any kind, including but not limited to implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and/or accuracy.

The Foundation will endeavour to provide the Site using all reasonable care and will use reasonable efforts to make the Site available to you at all times. However you acknowledge that the Site is provided over the internet and so the quality and availability of the Site may be affected by factors that are outside The Foundation’s reasonable control such as technical faults in your ISP’s and/or telecommunication providers’ network/service. The Foundation is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, providers, computer equipment or software, or failure of any email or User Content or competition entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any website (or any combination of these things).

The Foundation makes no guarantees that the Site will be available, uninterrupted or error free, or that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs. Except as required by law, The Foundation will not be responsible for any loss or damage caused by: (a) interruption or delay to the Site or errors, viruses or bugs contained in the Site caused by events outside The Foundation’s reasonable control; (b) your negligence, your breach of the Terms or failure to follow The Foundation’s reasonable instructions; (c) any incompatibility of the Site with any other software or material on your equipment; (d) any unauthorised use of the Site; or (e) any other factor that is outside The Foundation’s reasonable control.

Content, information and other material on the Site may contain inaccuracies and typographical errors. The Foundation does not warrant the accuracy or completeness of these or the reliability of any information displayed or distributed through the Site (including provided through any software). You acknowledge that reliance on any such information shall be at your sole risk. The Foundation reserves the right, in its sole discretion, to correct any errors or omissions in any part of the Site and to make changes to the Site and to the materials, products, programs, services, content or prices described in the Site at any time without notice.

The Foundation cannot accept any responsibility for any damage, loss, injury or disappointment suffered though use of the Site or any submission of User Content. In no event will The Foundation or its third party affiliates be liable for any damages whatsoever, whether in action of contract, negligence or other action, including (but not limited to) damages for loss of use of the Site, damage to equipment or other software, or loss of data or profits or for other monetary loss or for any indirect or consequential damages, arising out of or in connection with the use (or inability to use) or performance of the Site or participation in any competition. In addition, in no event shall The Foundation or its licensors or third party affiliates be liable for any unauthorised use of the Site.

These exclusions do not apply to death or personal injury caused by The Foundation’s negligence and only apply to the extent permitted by law. This does not affect your statutory rights.

12. THE FOUNDATION′S INTELLECTUAL PROPERTY RIGHTS, PRODUCTS AND SOFTWARE

The names, images and logos identifying The Foundation, its associated companies or third parties and their products and services are proprietary marks of these parties. Nothing in the Terms shall be construed as conferring any licence or right under any intellectual property right of The Foundation, its associated companies or any other third party unless expressly stated otherwise.

All copyright, trade marks and other intellectual property rights in the Site (including without limitation the design, arrangement and look and feel and the ‘4docs’ brand) and all material, software or content supplied as part of the Site, other than User Content and Your Data, shall remain at all times the property of The Foundation or The Foundation’s licensors and protected by copyright law.

13. LAW AND JURISDICTION
The Terms shall be governed by and construed in accordance with the laws of England. Any disputes arising from the Site or Terms will be decided only by the English courts.

Contributions to the Site are only sought from within the United Kingdom, whilst the Site is intended to be accessed globally. The Foundation makes no representation that materials on the Site are appropriate or available for use at other locations and access to them from territories where their contents are illegal is strictly prohibited. If you access the Site outside of the United Kingdom, you are responsible for compliance with all local laws.

If any of the Terms are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

1.1 General Information

The Channel 4 BRITDOC Foundation (together ‘The Foundation’, ‘Us’ ‘We’) own and are responsible for the 4docs.org.uk (the ‘Site’). Some areas of the Site may have specific terms and conditions, including privacy statements, that relate to specific content, practices and use of personal information. When visiting any areas of our Site, it is recommended that users consult any other additional privacy statements available.

The Foundation will use any personal information collected from the Site in accordance with all laws and regulations relating to the protection of personal data including the Data Protection Act 1998 (the ‘Data Protection Act’). 1.3 What information do we collect and why?

The information collected on the Site includes:

1.3.1 Users’ Internet Protocol (IP) addresses, which are automatically logged by our web server and are used by us and our partners to analyse activity on the Site at an aggregate level (number of visits and geographic optimisation etc). They are not cross-referenced with any other information such that an individual person could be identified.

1.3.2 Cookies are very small text files saved to your computer used to track user navigation around a website. Session cookies are also used to store information on which content, including advertisements, have been seen by a user. Some areas of our Site may also use persistent cookies which are permanently stored on the users’ computer. The Foundation will use such cookies to identify unique users to the Site. These are not cross-referenced with any other information such that an individual person could be identified.

We currently contract with several online partners to help manage and optimize our internet business and communications. To do this, we use Web beacons and cookies provided by our marketing company on the Site. The type of information we collect includes content viewed, pages, site sections and videos. By supplementing our records, this information helps us learn things like what pages are most attractive to our visitors, which of our products most interest our users, and what kinds of offers our users like to see. Although our marketing company logs the information coming from the Site on our behalf, we control how that data may and may not be used.

The Foundation may use a third party to deal with advertisements on the Site. The advertisers may use cookies to track the number of users responding to the campaign. The Foundation does not have access to or control of cookies placed by third parties.
